Welcome to QualityLab ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our mail at [email protected] and our app testing services (together or individually "Service") operated by QualityLab.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Service Description

QualityLab provides comprehensive app testing services including but not limited to functional testing, automated testing, performance testing, security testing, UI/UX testing, API testing, cross-platform testing, regression testing, and QA consulting.

Our services are designed to help identify bugs, usability issues, and performance bottlenecks in your applications before they reach your users.

3. Client Responsibilities

As a client of QualityLab, you agree to:

• Provide accurate and complete information about your application and testing requirements
• Respond to our queries in a timely manner
• Provide necessary access to your application and related systems for testing purposes
• Review and provide feedback on our testing reports within the agreed timeframe
• Maintain confidentiality of our testing methodologies and proprietary information

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of QualityLab and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of QualityLab.

5. Confidentiality

QualityLab acknowledges that in the course of providing the Services, we may have access to confidential information. We agree to:

• Maintain the confidentiality of your proprietary information
• Use such information only for the purpose of providing the Services
• Not disclose such information to any third party without your prior written consent
• Implement reasonable security measures to protect your confidential information

6. Payment Terms

Payment for our services shall be made as per the terms specified in the service agreement or proposal. Unless otherwise stated:

• All fees are quoted in Indian Rupees (INR) or US Dollars (USD) as specified
• Payment is due within 30 days of invoice date
• For projects exceeding one month, we may require milestone payments
• Late payments may incur a late fee of 1.5% per month

7. Limitation of Liability

In no event shall QualityLab, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or the like that may be transmitted to or through our Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

8. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
